Acceptance of Enkewa’s Terms of Use and Privacy is required to use our website.

These Terms of Use and Privacy govern the collection, processing, and use of your personal and non-personal information as a user of Enkewa, starting from the effective date stated above. They also outline the terms for using the website and its features (hereinafter the Service).

To process your personal data, Enkewa complies with applicable local and European legislation, as well as its development regulations.

2.- Description and Use of the Service

Enkewa offers an exclusive and private oasis to explore the magnificent African continent. In this way, they provide a professional service based on their experience in the field, offering a true safari with full contact with African nature in a preserved environment, in the heart of Masai Mara, Kenya.

Additionally, through the website, you can access information about Enkewa and the services it offers. Specifically, you can find:

  • Information about Enkewa, its history, and experience.
  • The various services it offers, such as safaris, travel planning, and cultural visits.
  • A contact form for requesting information and/or making reservations.

The contract between Enkewa and the buyer will be made in Spanish or English. In case of discrepancies between the translated versions, the Spanish version will prevail.

The website may link to other websites.

However, we do not exercise control over these sites or their content, which are subject to their own terms and conditions. We do not assume any association or responsibility for them, nor do we guarantee their technical availability, quality, reliability, accuracy, or truthfulness.

4.- Intellectual and Industrial Property

The content and information on Enkewa (including, among others, trademarks, logos, data, text, images, or computer code), as well as the hardware or software elements used to provide such content and information, are the property of Enkewa or are authorized for its use.

Therefore, under national and European intellectual property regulations, the modification, reproduction, duplication, copy, distribution, sale, resale, and other commercial exploitation of the Service and its content are prohibited.

For any other use of the content of the Service, prior written consent from Enkewa or, where applicable, the content authors is required.

5.1.- Content

You may contribute to the Service by sending us messages through our email address or via the contact form on the website (hereinafter «Content»).

We may use your Content in various ways, such as displaying it on the website, reformatting it, translating it into other languages, editing it for clarity, correcting errors, promoting it, or distributing it.

By sending us Content, you grant Enkewa a worldwide, non-exclusive, free, transferable, and sublicensable license to use that Content.

This means that the content remains yours, but Enkewa, under this usage license, may: a) use, reproduce, modify, adapt, translate, distribute, and publish the Content, create derivative works from it, display it worldwide through any known medium, and for any legitimate purpose; and b) use your name in connection with that Content.

However, Enkewa reserves the right not to publish any content or information that is false or violates third-party rights.

Regarding the use of the Service, you declare that you are of legal age and have the legal capacity to bind yourself by this agreement and use it in accordance with its terms and conditions, which you fully understand and acknowledge.

If you contract the Service on behalf of a company, you acknowledge having the proper authorization and representation for the organization.

You declare that all the information you provide to access the Service, before and during its use, is truthful, complete, and accurate.

7.1.- Information Collected

The personal and non-personal information collected will depend on how you use the website and its features.

The personal and non-personal information collected by the Service will be obtained in three ways: 1) automatically collected, 2) voluntarily provided by you, and 3) provided by third parties.

7.1.1.- Automatically Collected Data

This information consists of:

  • Data collected through cookies or similar mechanisms stored on your device, always with your consent. Please see our Cookies Policy for more information.
  • The IP address used for the connection, the device type and its features, operating system version, browser type, language, date, country, time of the request, referring URL, or mobile network used, among others.
  • Site usage data and potential errors detected during its use, such as pages not found or incorrect displays.

Additionally, Enkewa uses Google Analytics, an analytical service provided by Google, LLC, located in the United States at 1600 Amphitheatre Parkway, Mountain View, California 94043. This service uses cookies to collect information, including the user’s IP address, which will be transmitted, processed, and stored by Google as specified on the website www.google.com. This may include the transmission of this information to third parties for legal reasons or when such third parties process the information on behalf of Google.

7.1.2.- Data Provided Voluntarily

This information consists of:

  • The personal or non-personal data contained in messages sent through the contact channels provided on the Enkewa website, for example, your name, email, country, phone number, and message.
  • The personal information required to subscribe to the newsletter, such as your name and email.
  • Your photo, name, nickname, or geolocation if you choose to participate in any of our social media activities.

7.2.- Rights

The completion of forms is voluntary. However, if you do not fill in the required fields (usually marked with an asterisk), certain features of the Service may not be possible or may be limited.

The personal data you provide will be incorporated and processed in Enkewa’s Activity Processing Register, to address your requests, provide the requested service, and keep you informed about the company’s activities and services.

You can exercise your rights of access, rectification, deletion, limitation, opposition, and portability of your personal data at any time by sending an email to: 684-20500 Narok, Kenya or by postal address: media@enkewa.com.

In both cases, you must identify yourself with your full name and, if necessary, a copy of your ID or national ID.

If you have given consent for a specific purpose, you have the right to withdraw it at any time without affecting the legality of the processing based on consent before its withdrawal.

If you consider that there is an issue with how Enkewa is handling your data, you can file a complaint with the relevant data protection authority, with the Spanish Data Protection Agency being the one indicated in the case of Spain.

7.3.- Use of Data

Enkewa will use the collected data to:

  • Manage, provide, and update the Service (our legitimate interest in keeping the Service up-to-date and in good condition).
  • Address any inquiries you make (our legitimate interest in attending to user requests).
  • Provide the service if contracted (contractual basis).
  • Send you newsletters by email (either based on the contractual relationship or our legitimate interest in direct marketing actions, according to art. 21.2 of the LSSICE).
  • You can unsubscribe from these emails directly via the email link or by contacting us at media@enkewa.com. However, you cannot unsubscribe from specific communications, such as security messages about your data or service terms and conditions.

Enkewa will not use automated individual decisions.

Additionally, Enkewa may use user data in the form of aggregated and anonymized data for display to third parties. It may also share user statistics and demographic information with third parties, but none of this will allow third parties to personally identify you.

7.3.1.- In Emails and Contact Forms

The site has TLS encryption, which ensures secure transmission of your personal data through standard contact forms.

The personal data collected will be processed automatically and included in the relevant activity files.

7.3.2.- In Social Media

We have profiles on several major social media platforms, and Enkewa is responsible for processing data related to content published there (e.g., photos uploaded by Enkewa showing people’s faces).

We will only process data within the limits allowed by the social media platforms.

In any case, we do not extract data from social media unless we explicitly obtain user consent for it.

7.4.- Data Retention

The following outlines the retention periods for data processed by the Service:

  • Aggregated data will be kept indefinitely.
  • User data will be retained for up to 12 months to handle their requests.
  • Data from users who acquire the service will be kept for the minimum time necessary.

8.- Service Providers and Others

There are third parties that manage parts of the Service. Enkewa requires them to comply with these Terms of Use and Privacy where applicable, and they must have their own policy. Enkewa is not responsible for ensuring compliance with their policies.

Enkewa may share, use, preserve, or disclose personal information with third parties when necessary to provide the Service, or cooperate with authorities when legally required.

9.- Liability

As far as the law allows, Enkewa is not responsible for errors or omissions in content, unavailability of the website, or the transmission of malicious programs in content, despite adopting all reasonable technological measures to prevent it.

10.- Modifications

Enkewa reserves the right to make changes to the website without prior notice, including adding or removing content and services or changing how they are presented.

These terms may also change at any time, and any modifications will take effect from the moment they are published.
